WAIVER OF CLAIMS
I, will win each GR Yaris Time trial award or each GR Yaris Scapes Image Competition award,their various activity hereby agree:
- to comply with TMC’s rules, regulations, and instructions to ride in and/or drive any vehicles owned, operated, controlled or maintained by TMC, its subsidiaries, affiliates, and related companies (collectively, “TOYOTA”) used for GR Yaris Time trial or GR Yaris Scapes Image Competition,their various activity ;
- that driving or riding the Vehicles, on the roads used for GR Yaris Time trial or GR Yaris Scapes Image Competition,their various activity, could be an inherently hazardous activity involving a possibility of risk of serious injury or death, and agree that I am voluntarily participating with full knowledge of the danger involved and hereby agree to assume any and all risks of injury or death which may result from my participation in events related to winning each GR Yaris Time trial award and each GR Yaris Scapes Image Competition;
- that TOYOTA may use my photo or video images only for GR Yaris Time trial and GR Yaris Scapes Image Competition or their related marketing promotion, whether internally or externally, without my prior consent and without charge to TOYOTA;
- that TOYOTA may use my information about personal name and details only for for GR Yaris Time trial and GR Yaris Scapes Image Competition or their related marketing promotion without charge to TOYOTA, provided that TOYOTA observe newly established European General Data Protection Regulation (GDPR) policy and other applicable regulations;
- to release, indemnify and hold TOYOTA harmless from any liability, causes of actions, damages, whether direct, consequential or incidental damages, claims whether for personal injury, death, property damage or the like, whether to my person and property or that of others, and ride on the vehicles for GR Yaris Time trial and GR Yaris Scapes Image Competition, provided that they are not attributed to TOYOTA;
- TOYOTA or Toyota Gazoo Racing e-Motorsports Secretariat (in Toyota Connected Corporation) may send emails to addresses provided below in the future for cooperation request, etc. for GR Yaris Time trial and GR Yaris Scapes Image Competition or their related marketing promotion activities,
- that this Waiver of Claims shall be governed by the laws of Japan and that any matter arising out of, related or incidental to, this Waiver of Claims, if any, shall be submitted to the exclusive jurisdiction of the Tokyo District Court;
- that this Waiver of Claims is intended to be as a broad and inclusive as permitted under the Japanese laws, and that if any portion of this Waiver of Claims is held invalid, the balance of this Waiver of Claims shall continue in force and effect; and
- that this Waiver of Claims shall insure to the benefit of and shall be binding upon any successors, assignees, and heirs of myself.
I will voluntarily and at my own will send an email to the TOYOTA GAZOO Racing e-Motorsports Secretariat to waive this claim.
